These terms and conditions (“Terms”) govern any purchase made with us through our website, mobile app, SMS, or other platforms. By making a purchase, you agree to these Terms. If you do not agree to these Terms, please refrain from making a purchase.

We may update these Terms periodically, and the most current version will apply to each purchase. We will notify you of any changes via email. Please carefully review these Terms before making a purchase, as they outline our liability limitations under specific circumstances.

Definitions

In these Terms, capitalized words have the following meanings:

App: Our website and mobile applications.

Event Outside Our Control: Any event beyond our reasonable control, as explained in paragraph 2, such as the unavailability of any Service Provider, key personnel, or necessary materials to provide our services.

Item: Any clothing or article collected from you in connection with a purchase.

Purchase: Your request for our services, as detailed in the order form submitted through the App.

Services: Personal dry cleaning or laundry services collected from and delivered to your specified address.

Service Providers: Any third party engaged to assist in providing the Services.

Terms: These terms and conditions, as updated periodically.

We/Our/Us: Our company, including subsidiaries and affiliates.

“Writing” or “written” includes email and notifications via the App.

Placing an Order

Make sure to check the details of your order before submitting it, as we are not responsible for any errors you make. If you notice a mistake, contact us as described in paragraph 13. We will confirm any changes to your order by email, as mentioned in paragraph 4.

Submitting an order does not create a contract between us. A contract is established when we email you to confirm acceptance of your order. Each order will be assigned an order number, which you should reference in all communications with us. If we cannot fulfill your order, we will notify you via email or text message.

 

 

 

Changes to Your Order

You may change your Order before the collection time specified in our email acceptance by contacting Customer Service at info@laundrypeak.com. With your consent, we may alter your Order as an alternative to canceling it under certain conditions.

 

Cancelling or Rescheduling Your Order

You may cancel your Order:

 

1. Before the collection day specified in our email acceptance by contacting Customer Service.
2. After we have collected your Item(s) if affected by an Event Outside Our Control.

 

Once an Item has been collected, cancellation rights under the Consumer Contracts Regulations or equivalent laws may no longer apply. Rescheduling within two hours of the agreed collection/return window or outside office hours (8am-8pm weekdays) may incur additional fees, subject to availability.

Our Rights to Cancel Your Order

We may cancel your Order:
1. Due to an Event Outside Our Control.
2.
If you fail to make Items available for collection.
3.
If an Item does not correspond with the Order, is damaged, lacks information about its content or cleaning instructions, or falls outside the scope of accepted Items.

 

If we cancel your Order, we will notify you and, if we have already started work on your Order, we will not charge you. We will arrange redelivery of the Item(s) as soon as possible.

Collection and Redelivery

We will endeavor to collect and redeliver Items at the specified times, but cannot guarantee this. We will communicate any delays by phone or email. If you are unavailable for redelivery, we will reach out to you to arrange a convenient time. 

 

 

Ensure we have the necessary access and parking facilities to perform the Services.

Wash and Tumble Dry Orders

Washing and Drying Process: Items are washed at 30 degrees and tumble dried at medium heat. We may not cater to personal requirements. Items are not ironed.

 

Color Separation: We separate clothes into lights and dark but accept no responsibility for color transfer.



Damaged Items: We are not liable for damage, as we do not inspect care labels. Ensure delicate items can be machine washed and tumble dried.

 

Tagging: Items are tagged by load, not individually, and we accept no liability for missing items.

 

Checking Items: Ensure all garments are checked for hazardous items. We are not responsible for lost or damaged items resulting from the cleaning process.

If There is a Problem with the Services

Contact Customer Service at info@laundrypeak.com if you encounter any problems. Complaints should be notified within 48 hours of redelivery.

Your statutory rights are unaffected by these Terms.

Price and Payment

Prices are set out in our price list on the App or website and are current at the time of your Order.  Payment is captured upon order placement but processed after cleaning. If the final total exceeds the captured total, adjustments will be made. Payments are taken from the card provided with your Order. Failure to make payment may incur interest and fee charges.

Our Liability to You

In case of loss or damage, compensation will follow the Fair Compensation Guidelines by the Textile Services Association. Total liability per Item is limited to ten times the service price, up to $200.00, with proof of purchase. Inspect Items upon delivery and report any issues within 48 hours.

We are not liable for:

– Items valued over $200.00 unless notified via email prior to collection.

– Foreseeable loss or damage.

– Business-related losses.

– Damage resulting from failure to notify special cleaning requirements, pre-existing damage, extraneous items, normal wear and tear, or incorrect labeling.

Our liability is not excluded or limited for death or personal injury caused by negligence, fraud, breaches of the Supply of Goods and Services Act, or defective products under the Consumer Protection Act.

Events Outside Our Control

We are not liable for failure to perform or delays caused by Events Outside Our Control. If such an event occurs, we will notify you, and our obligations will be suspended for the duration of the event. You may cancel your Order if affected, and we will return your Item(s) at no cost.

# How We May Use Your Personal Information

 

We will use your personal information to provide the Services, process payments, and inform you about similar services unless you opt out. Personal data will not be shared with third parties except Service Providers.

Quality Guarantee

We inspect each garment before return. If unsatisfied, contact us within 24 hours for a free re-clean. Requests after 24 hours are discretionary.

LaundryPeak SMS Terms and Conditions

By opting in to receive SMS communications from LaundryPeak, you agree to the following terms and conditions:

1. Opt-In: By subscribing to LaundryPeak SMS services, you agree to receive SMS messages, including order updates, promotional offers, and other notifications, to the mobile number you provided.

2. Message Frequency: The number of SMS messages you receive will vary depending on your interactions with LaundryPeak, including but not limited to, order status updates and special offers.

3. Message & Data Rates: Standard message and data rates may apply based on your mobile carrier’s plan. Please consult your mobile carrier for details on applicable fees.

4. Opt-Out: You may opt out of receiving SMS messages at any time by replying "STOP" to any message received from LaundryPeak. After opting out, you will receive a confirmation message, and no further SMS messages will be sent unless you opt back in.

5. Help: If you need assistance or have any questions regarding our SMS services, you can reply "HELP" to any of our messages, or contact us at info@laundrypeak.com.

6. Privacy: Your privacy is important to us. Please review our SMS Privacy Policy for details on how we collect, use, and protect your information.

7. Service Availability: LaundryPeak’s SMS services may not be available on all mobile carriers and may be subject to service limitations or interruptions. We are not responsible for any delays or failures in receiving messages due to network issues.

8. Modification of Terms: LaundryPeak reserves the right to modify these SMS Terms and Conditions at any time. Any changes will be communicated through our website or directly via SMS.

9. Limitation of Liability: LaundryPeak is not liable for any direct, indirect, or consequential damages arising from your use of our SMS services, including but not limited to, delays or errors in message transmission.

10. Governing Law: These terms and conditions are governed by the laws of Massachusetts, United Estates. , and any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Massachusetts, United Estates. 

By subscribing to LaundryPeak SMS services, you acknowledge that you have read, understood, and agreed to these terms and conditions.
